Dana Gas sukuk dispute may be prolonged by UAE court delay
Dana Gas , which is seeking to restructure USD700mn of Islamic bonds it claims have become unlawful, said on Monday that it might take several months to obtain a stay of proceedings in a UAE court. The delay may reduce the chances of sukuk holders being repaid when the bonds mature in October. Dana initiated proceedings in a Sharjah court last month, claiming the bonds had become unlawful in the UAE following changes in Islamic finance interpretations over recent years. This month the London High Court ordered Dana to stay the Sharjah proceedings and have the Sharjah court lift an injunction protecting Dana from claims, pending a full hearing of the case by the London court in September. On Monday, however, Dana said it had been informed by its lawyers that its application to stay the Sharjah proceedings would need to be made jointly with other respondents in the case.
