Cleopatra Hospital Company: River Transport Authority files lawsuit requiring payment for NBH piece of land; any resulting loss to be paid by old owners
Al Borsa reported that The Nile Transport Authority continues to press a claim against Cleopatra Hospital Company’s (CLHO.CA) Nile Badrawi Hospital, asking it to pay EGP43mn for the hospital's land, as well as a compensation. Cleopatra Hospital Company clarified in a bourse statement that it had taken legal precautionary procedures to avoid any action being taken by River Transport Authority on the land in response to the lawsuit made by the River Transport Authoirty. The River Transport Authority’s request included: EGP36mn for the value of the land, EGP7mn for the prior use of the land and EGP20mn compensation, as well as voiding the ongoing agreement between Abraaj Group and NBH for the sale of land. CHC clarified that the lawsuit is currently being handled by the Investors Dispute Settlement Centre, and that it has the right to get back to the NBH's old owners to compensate it for any loss or commitment as a result of the land dispute. In CHC’s defense, it will refer to: i) the ministerial investment dispute centre approval in 2003, where the River Transport Authority did not object to the sale of land in return for a suitable compensation, which was decided to be of the same value paid to Cairo governorate when the land was purchased; ii) Article 9 of the Investment Law, which stipulates that it is forbidden to take an administrative decision to apply guardianship, freeze, or confiscate the funds or premises of any company subject to the Investment Law. Earlier in October, Investors Disputes Settlement Centre had notified the River Transport Authority on 27 October that NBH is subject to Egypt’s Law of Investment Guarantees and Incentives.
