Cleopatra Hospital Company: Court of Appeals rules in favour of Nile Badrawi Hospital in ongoing land dispute case with River Transport Authority

Cleopatra Hospital Company (CHC) [CLHO.CA] announced in a bourse statement that the Court of Appeals has ruled in favour of CHC’s Nile Badrawi Hospital’s (NBH) appeal against the River Transport Authority lawsuit to seize the land on which NBH is established (no seizure was executed on NBH, just a lawsuit). CHC is yet to receive an official copy of the ruling. The lawsuit is related to a dispute on the purchase price of the plot of land between original owners of NBH (pre-Abraaj’s acquisition of NBH) and the River Transport Authority, where the latter is disputing against the purchase price of the land it had received from the previous owners and had previously required EGP36mn for the value of the land, EGP7mn for the prior use of the land and EGP20mn in compensation, as well as voiding the ongoing agreement between Abraaj Group and NBH for the sale of land. CHC had clarified earlier that it has the right to get back to NBH's old owners to compensate CHC for any loss or commitment as a result of the land dispute. CHC had earlier mentioned that, in its defence, it will refer to: i) the ministerial investment dispute centre approval in 2003, where the River Transport Authority did not object to the sale of land in return for suitable compensation, which was decided to be of the same value paid to Cairo governorate when the land was purchased; ii) Article No. 9 of the Investment Law, which stipulates that it is forbidden to take an administrative decision to apply guardianship or to freeze or confiscate the funds or premises of any company subject to the Investment Law.
